Due Process - from an Escambia County Judge

The question was about the timing involved when a "multiple" petition is filed for Value Adjustment Board appeals. There were some questions about the standards in several statutes, which affected quite a number of condominium association members.

But resolving the timing questions, which appears to have occurred before all sides got to court, was not the key, in our opinion. What caught our attention was the judge who expressed concerns about the due process rights of taxpayers, and mentioned "good faith".

And, the judge really understood the various protocols involved in the VAB process, identifying them in rapid order. The outcome favored taxpayers - government applied statutory provisions to enable the petitions to be heard without cutting short the calendar.

Of course, now the same petitioners have to have good faith and due process at their hearings. And, that's another matter.
